Por dicho motivo, una amplia mayoría de los ciudadanos españoles desprecia a la casta política y asisten anonadados a un espectáculo de corrupción generalizada, de incumplimiento de las sentencias judiciales y de ataques reiterados a la Constitución por medio de actos administrativos, de nuevas leyes y estatutos de autonomía, y de intentos de ruptura de la unidad de España, sin que exista reacción contundente por parte del Gobierno y del Parlamento con la aplicación del artículo 155 CE.

1) Soberanía de la Ley

La sociedad civilizada se diferencia de las tribales y colectivistas porque prevalece el principio de soberanía de la Ley que permite que exista un marco institucional que proporciona seguridad (exterior, interior y jurídica) a los derechos individuales a la vida, a la libertad, a la propiedad y a la igualdad de trato ante la ley.

El principio de soberanía de la ley requiere que haya un cumplimiento estricto de la misma siempre que el marco institucional respete los derechos fundamentales, arriba mencionados. Por dicho motivo, es exigible jurídicamente a los gobernantes y a los ciudadanos que cumplan las leyes y las sentencias judiciales. Es lo que posibilita que exista un régimen político en un país con un Estado de Derecho, digno de tal nombre, y lo que permite fundamentar la dispersión pluralista del poder, la división y la separación de poderes, y la elección democrática de los representantes públicos.

Como señala Pedro Schwartz en su obra En Busca de Montesquieu (2006):

La esencia de la ‘doctrina Montesquieu’ estriba en que un solo poder no pueda tomar decisiones colectivas sin la colaboración, apoyo, refrendo o revisión de otro (…)

El principio de separación y división de poderes no sería sostenible si no se aceptara la idea de que la ley está por encima de los tres poderes, ejecutivo, legislativo y judicial: no sólo están sometidos a ley los gobiernos y administraciones que ejercen el poder político, sino también las cámaras que promulgan leyes, así como los propios tribunales que las interpretan o, en su caso, las adecuan a las circunstancias del caso (…)

Si existen normas constitucionales y, por encima de ellas, principios generales del Derecho que deben ser respetadas en nombre de la soberanía de la ley, entonces sí podemos considerar esta doctrina compatible con el funcionamiento ordinario de la democracia.

(Schwartz, 2006: 26-27).

2) Deterioro de la Ley en España

Por ello, ante los desafíos institucionales, hay que recordar como Bruno Leoni indicaba en su obra La Libertad y la Ley (2010) [1961] la importancia del derecho consuetudinario, el perjuicio que ocasiona el derecho positivo y la errónea creencia de que la ley pudiese ser todo aquello que les plazca a los políticos.

De hecho, analizando el fundamento legal del orden constitucional democrático en España, se observa un proceso de descomposición del marco institucional que sólo podía terminar en los desafíos y los intentos de ruptura por parte de los políticos nacional-separatistas. Se trata de un proceso de deterioro legislativo por la degradación de las leyes y de las instituciones que deben velar por su cumplimiento.

Junto con los nuevos estatutos de autonomía, quizás sea el deterioro normativo más importante la insólita reforma del Código Penal aprobada en el año 1995 que eliminó de un plumazo parte de la tipología de los delitos de traición, sedición y rebelión que estaban contemplados en los anteriores códigos penales vigentes en España. Dicho acto de imprudencia legislativa parece ser que fue pactado por los dos partidos mayoritarios, actuando como representantes del PSOE y del PP, el Sr. López Aguilar y el Sr. Michavila, respectivamente.

Como explicaré a continuación, el deterioro normativo del Código Penal de 1995 merecería pasar a los anales de la historia por la negligencia, el dolo o la felonía que supone para los ciudadanos españoles que ratificaron la Constitución Española y que deben contar con los instrumentos penales para defender la convivencia pacífica e integradora que se instauró el 6 de diciembre de 1978. El 12 de noviembre de 2012, asistí estupefacto a un acto en el que se leyó un discurso [6] del magistrado Adolfo Prego en el Hotel Intercontinental de Madrid, en donde razonaba como sigue:

En España hoy si un parlamento autonómico, tras la votación de sus miembros, proclama formalmente la secesión de una parte del territorio español erigiéndolo en Estado independiente, no se comete delito alguno. Repito: en la España de nuestros días eso no sería delictivo. Nadie incurriría en responsabilidades penales por perpetrar un ataque de esa naturaleza a la unidad nacional y al orden constitucional Una parte importante de la culpa de que los políticos regionales jueguen a la independencia está en el Parlamento de España que legisló el deterioro normativo del Código Penal.

Efectivamente, aún hoy sigue sin solventarse esta laguna legal que ocasionaron nuestras Señorías en la Ley Orgánica 10/1995, de 23 de noviembre, del Código Penal, lo que posibilita que se planteen los desafíos nacional-separatistas de las oligarquías extractivas y destructivas de Cataluña, País Vasco, Galicia, Canarias y de cualesquiera autoridades regiones o locales con ansias de poder absoluto sobre el territorio:

2.1. Reducción del Delito de Traición

Se rebajaron las modalidades del delito de traición que recogían los artículos 581 y siguientes en el Código Penal de 1995 por lo que, ahora mismo, ya sólo se contempla el caso de un conflicto bélico entre España y otro país. Hasta el año 1995, también existía el derecho de traición por conflictos internos provocados por sediciones separatistas. Curiosamente, ahora ya no es un delito de traición el plantear un conflicto interno de ruptura con el marco institucional del propio país en contra de la Constitución que ratificaron mayoritariamente los españoles.

2.2. Insuficiencia del Delito de Sedición

Se legisló el delito de secesión en los artículos 544 y siguientes del Código Penal de 1995 sobre la base de un alzamiento público y tumultuario, es decir, en relación con la idea de un motín que atenta contra el orden público pero no se consideró como tal una declaración de independencia proclamada por una asamblea legislativa o por un gobierno autónomo que, por supuesto, atacaría gravísimamente el orden constitucional y la unidad de España de un modo no tumultuario.

2.3. Insuficiencia del Delito de Rebelión

Se legisló el delito de rebelión en el artículo 472 del Código Penal de 1995 sobre la base de un alzamiento público y violento. Por ello, quedan fuera del delito de traición aquellos alzamientos que pudiéramos llamar pacíficos, por muy eficaces que sin embargo pudieran ser para la consecución de la independencia.

2.4. Insuficiencia del Delito de Desobediencia

Se limitó el delito de desobediencia en los artículos 410 y siguientes del Código Penal de 1995 tipificando los cometidos por funcionarios frente a sus superiores. Un particular que desobedece gravemente a un Tribunal comete un delito castigado con privación de libertad de 1 año. Sin embargo, cuando es una autoridad quien se niega abiertamente a dar debido cumplimiento a una resolución judicial la pena se reduce a una simple multa y a la inhabilitación para empleo o cargo público. Obviamente, estas fisuras normativas no se dan en otros países europeos, sólo en España.

El Código Penal anterior, que estuvo vigente hasta el año 1995, incluía en el artículo 214 la declaración de independencia de parte del territorio nacional entre los fines de un alzamiento rebelde y sin que se exigiese requisito alguno de violencia. Por su parte, el artículo 217 prescindía incluso del alzamiento como requisito, castigando como derecho de rebelión a los que cometieran los delitos del artículo 214 "por astucia o por cualquier medio contrario a las leyes".

En definitiva, anteriormente, el Código Penal protegía adecuadamente el orden constitucional castigando el delito de rebelión con una pena de prisión de 6 años y 1 día y hasta 12 años a aquellos que: "atentaren contra la integridad de a nación española o la independencia de todo o parte del territorio bajo una sola representación de su personalidad como tal nación".

Por ello, tiene sentido afirmar que el nacional-separatismo se ha alimentado por las sucesivas concesiones de los políticos del Gobierno y del Parlamento de España que han demostrado no estar a la altura intelectual y moral que merecen los ciudadanos de la nación que les acoge, dado que nuestras Señorías han deteriorado el Código Penal mediante la rebaja de la tipología en los delitos de traición, sedición, rebelión y desobediencia que, anteriormente, permitía hacer frente con certidumbre jurídica a los desafíos institucionales que intentasen quebrantar la Constitución y el resto del ordenamiento jurídico vigente.

En todos estos años, nuestras Señorías han sido incapaces de corregir dicho deterioro normativo. Por el contrario, han seguido ayudando a los intereses secesionistas de desvertebración territorial, cuando han presionado al Tribunal Constitucional para evitar que fuesen declarados inconstitucionales los nuevos estatutos, cuando han intervenido sobre la independencia de los fiscales y jueces para que los delitos de corrupción no fuesen correctamente investigados en tiempo y forma. De hecho, ahora mismo, a pesar de tener la mayoría absoluta de los votos en el Parlamento, prefieren seguir negociando concesiones y terceras vías ante el chantaje de los separatistas.

Ya explicamos [AQUÍ] las medidas que se adoptaron en el año 1934 ante una declaración unilateral de independencia de Cataluña y la posibilidad de aplicar medidas similares en el 2014 para proteger el vigente ordenamiento jurídico constitucional. Esperemos que, en caso de precisarse, las Señorías sean capaces de aplicar hasta sus últimas consecuencias el artículo 155 CE para frenar el secesionismo.

3) Impunidad de los delitos

Durante los últimos 30 años, los políticos nacional-separatistas han contado con una patente de corso, operando con impunidad para cometer delitos, incumpliendo sentencias del Tribunal Supremo, contando con la rebaja en las modalidades penales de los delitos de traición, sedición y rebelión, además de las ventajas por la prescripción de delitos, la rebajas de penas o la imposibilidad de cumplimiento de condenas a partir de los 70 años de edad que han contribuido a que aumentasen exponencialmente los casos de corrupción. Desde el año 2012, incluso cuentan con una ley de amnistía fiscal que parece hecha ad hoc para que los delincuentes patrios puedan legalizar las fortunas conseguidas ilícitamente.

Los ciudadanos asistimos atónitos a un rocambolesco espectáculo que podría calificarse de comedia, si no fuese un asunto muy serio porque el dinero robado proviene de nuestras carteras y las leyes e instituciones deterioradas constituyen nuestro marco institucional.

Refiriéndose al libro El secuestro de la justicia de José Luis Herrera y de Isabel San Sebastián, el periodista José María Carrascal en ABC [7] nos recordaba el pasado domingo que el gobierno socialista de Felipe González presionó a los fiscales y magistrados en los años 1984 a 1986 para que no hubiese indicios de delito en el caso de Banca Catalana y para que Jordi Pujol pudiese continuar su carrera política a pesar de que el informe de la fiscalía era demoledor.

4) Corrupción generalizada

Con aquellas pajas, hemos obtenido estos mimbres. El periódico EL MUNDO [8] informaba ayer, martes 9 de septiembre, sobre el "modus operandi" que empleaba el ex presidente Jordi Pujol exigiendo, supuestamente, mordidas a los empresarios en persona y desde su despacho de la Generalitat:

El modus operandi era sistemáticamente el mismo, tal y como coinciden en afirmar bajo garantía expresa de anonimato media docena de empresarios que tuvieron que satisfacer el peaje. El President abría una pequeña libreta repleta de anotaciones numéricas y soltaba una cantinela que palabra arriba, palabra abajo no variaba demasiado: «Según mis cuentas, la cantidad que debe abonar es…». Claro que también había advertencias a los que se resistían: «Si Usted no paga, me temo que tendrá que resignarse a no hacer nunca nada más en Cataluña». El mesianismo del personaje le llevo en alguna ocasión a espetar a algún contratista que se demoraba: «Le debe usted a Cataluña».

De hecho, si fuese así, la realidad de la corrupción en Cataluña superaría con creces la ficción de la obra Ubú President de la que ya incluimos un fragmento en el comentario del desafío institucional en Cataluña y que, a la luz de la información publicada ayer por el periódico EL MUNDO [8], tendría la siguiente operativa para el pago de comisiones por empresarios para obtener las licitaciones públicas en Cataluña:

Eso sí, daban todo tipo de facilidades: «Te ponían encima de la mesa tres variantes: ‘Nos lo puede abonar en A, es decir, con factura a través de una sociedad instrumental; en B (dinero negro) que inmediatamente era evacuado a Andorra, o en una cuenta en Suiza’. Era un comportamiento mafioso pero, o cedías, o tenías que borrar Cataluña del mapa», relata otro extorsionado. La tarifa oficial era del 3%, tal y como reveló en 2005 Pascual Maragall. Este porcentaje subió al 4% tras la creación de la trama del Palau, ya con Pujol fuera del Ejecutivo. De ese 4%, el 2,5% era para CDC y el 1,5%, para sus dirigentes, según figura en el borrador de la UDEF que publicó EL MUNDO en noviembre de 2012.

Draguinomics: adding fuel to the fire

Pese a que los verdaderos cambios los realizó en Junio, Mario Dragui volvió a sorprender este jueves pasado con una bajada de tipos histórica del 0,05% y su intención de compra de activos y deuda.

Pese al apoyo incondicional de la inmensa mayoría de la prensa, políticos y economistas mainstream de cabecera, estas medidas no conseguirán los objetivos que se proponen sino que echarán todavía más leña al fuego. Veamos los motivos.

Fomenta el hiperendeudamiento y malas inversiones

Debía haber quedado claro que actualmente estamos sufriendo una crisis de deuda. Todos los agentes de la economía están endeudados en exceso. Sin ir más lejos, la deuda estatal ya está en máximos históricos por encima del 100% del PIB, algo para alarmarse ya que significa que la productividad marginal de la deuda cae por debajo de 1 (punto de no retorno ya que la deuda se incrementa más que la producción de bienes y servicios).

Años después del estallido de la crisis, todavía estamos en la etapa de purgar proyectos erróneos y malas inversiones fruto de los bajos tipos de interés otorgados por las autoridades monetarias. Proyectos con un ratio de retorno bajísimo que se han mostrado inviables una vez detonada la crisis. Para superar la recesión es imprescindible que estos recursos mal invertidos se reasignen y que los agentes económicos se desapalanquen.

Por este motivo, lo lógico sería que los bancos centrales dejasen de aplicar políticas monetarias hiperexpansivas con el objetivo de reanimar la economía, ya que el acceso a liquidez prácticamente gratuito fomentará nuevas malas inversiones e impedirá que se liquiden las del pasado, además de dificultar enormemente el desapalancamiento de los agentes económicos.

La solución que propone el BCE es ¡solucionar un problema de deuda con más deuda! Algo tan singular como intentar apagar un fuego echando más leña o encendiendo un lanzallamas. Más bien al contrario, el camino no debe ser el hiperendeudamiento, sino eliminar el sobreapalancamiento de la economía mediante la amortización de deuda

La liquidez no llegará a la “economía real”

Uno de los objetivos de las medidas del BCE es reactivar el crédito bancario para que llegue a familias y empresas, fomentando de esta manera la inversión y el consumo. Algo que no ha ocurrido en el pasado y no va a pasar ahora por mucho que los policy-makers penalicen a los bancos (-0,2%) por mantener el exceso de liquidez en el BCE.

Repito, algo que no pasará por varios motivos:

1) El Estado absorbe todo el crédito del sistema. Un efecto crowding out en toda regla que desplaza al sector privado y que surge como consecuencia de la imposibilidad del gobierno de cuadrar sus cuentas y caer sistemáticamente en déficit. Como los Estatutos prohíben adquirir deuda soberana directamente al BCE, asistiremos a otro carry trade en toda regla sin ninguna duda. De esta manera veremos como los Estados podrán seguir gastando todavía más (ahora el gasto público español está en torno a un 45% del PIB) y también comprobaremos como la deuda soberana estará en mínimos de hace unos cuantos años.

2) Familias y empresas no tienen capacidad de endeudarse más. El propio BCE reconoce que la demanda es débil. Por mucho que se ofrezca crédito barato no se podrá conceder. De hecho, los tipos estaban ya bajísimos al 0,15%. Es dudoso que al 0,05% se desate una desaforada demanda de crédito.

3) La demanda de crédito no es solvente. Las familias y empresas que sí demandan están sobreendeudadas y/o no presentan planes de negocios viables y sostenibles por lo que el crédito no se les concede por el riesgo inherente que conlleva.

4) Los bancos necesitan fondos para reestructurarse financieramente, financiarse de manera barata y cumplir los diversos requisitos de core capital de Basilea III. Por tanto, se trata de reducir las actividades que consumen más capital (préstamos a pymes tienen una ponderación del 100%) y sustituirlas por actividades menos costosas en términos de ROE (invertir en el bund alemán no consume capital).

Por tanto, los grandes beneficiados no serán las familias y empresas, sino gobiernos y bancos.

¡El problema es de solvencia!

El punto de partida erróneo es pensar que el problema que se les presenta a los bancos es de liquidez. No, es un problema de solvencia. Dicho de otra manera, no es que no puedan conseguir financiación para mejorar su flujo de caja, sino que el valor de sus deudas está muy por encima al valor de sus activos.

En su momento, las entidades de crédito se aprovecharon de los bajos tipos de interés para adquirir deuda a corto plazo para invertir a largo (hipotecas). Ahora los bancos son insolventes porque no pueden hacer frente a sus deudas, y eso no se soluciona con liquidez, sino liquidando malas inversiones. Bajar los tipos de interés no es la solución a un problema de insolvencia, ya que un banco quebrado no va a prestar el dinero que reciba, sino intentar saldar sus deudas.

Conclusión

Aceptemos la realidad: los planes de estímulos y bajadas de tipos de interés van a ser medidas ineficientes por los motivos que hemos expuesto. La prosperidad que vivimos en el pasado fue artificial, basada en deuda y dinero artificial y no en ahorro real. Ahora toca ahorrar para pagar la deuda, no seguir endeudándonos. Toca purgar las malas inversiones y recolocar capital, recursos y trabajo en otras líneas productivas demandadas. Y todo ello requiere tiempo, notables reformas estructurales y disminución de la intervención y obstáculos políticos.

Y es que no se puede intentar salir de una burbuja creando otra (y manteniendo las pasadas). Que se lo digan a Japón que decrece a un -7% y lleva varias décadas en recesión. Esperemos que nuestro rumbo sea distinto.

El ‘paraíso’ que vende Podemos es el sistema más corrupto, inseguro y despilfarrador del mundo

El partido de Pablo Iglesias ha sido tachado habitualmente de populista y anti-sistema debido a la radicalidad que incluye buena parte de su programa político. Según los expertos, el éxito que está cosechando Podemos en las encuestas electorales responde, en buena medida, al descrédito de la clase política española y a la sensación de impunidad que ostentan los grandes partidos.

No en vano, la corrupción y los políticos se han aupado como los principales problemas del país durante estos últimos años, tan sólo superados por el paro y los efectos de la crisis. La habilidad mostrada por Iglesias y sus socios para identificarse con el "pueblo" y culpar a la"casta" de casi todos los males que padece España constituye el núcleo de su particular estrategia política.

Pero, ¿en qué se traduciría realmente su alternativa? La regeneración democrática que vende Podemos consiste, básicamente, en un control casi total del Estado sobre la economía, con muchos más impuestos, más gasto público y la nacionalización de los grandes industrias y sectores denominados "estratégicos".

En esencia, el ejemplo a seguir que propone la formación de Iglesias no es otro que el "socialismo del siglo XXI" instaurado en Venezuela o Argentina, un modelo político amplia y abiertamente aplaudido por Podemos.

¿Solventaría este sistema la grave corrupción institucional que sufre España? Los datos prueban justo lo contrario: los paraísos socialistas que tanto defiende este partido son, en realidad, los países más corruptos, inseguros y despilfarradores del mundo. Así pues, lejos de solventar las profundas deficiencias que sufre la política española, exacerbaría hasta el extremo sus defectos en caso de seguir la senda marcada por el reciente chavismo venezolano o el ya crónico peronismo argentino.

Líderes en corrupción

En concreto, Venezuela es el país más corrupto del mundo, según el último Índice de Competitividad Global elaborado por el Foro Económico Mundial, correspondiente a 2014, en donde se analiza un total de 144 economías. Su nota en este ámbito es de 1,7 puntos, en donde 1 es la valoración mínima y siete la máxima. Por detrás de Venezuela se sitúan Líbano, Paraguay, Angola, Nigeria y Argentina, cuya posición en el ranking es el 139.

España también suspende, con una nota de 3,1, y su valoración es pésima en lo que a corrupción se refiere siendo uno de los países más desarrollados del mundo, pero su puesto 80 está a una gran distancia del que ostentan los grandes referentes políticos de Podemos.

Bajo el epígrafe "corrupción", el Foro Económico Mundial mide tres indicadores muy concretos:

Desvío de fondos públicos: Venezuela vuelve a ser líder absoluto (144), seguido de Argentina (143), mientras que España ocupa el puesto 90 del mundo.
Confianza de la población en los políticos: aquí Venezuela ocupa el puesto 143, sólo superado por Líbano, Argentina se sitúa en el 141 y España en el 117.
Pagos irregulares y sobornos: Venezuela se mantiene entre los peores puestos (137), mientras Argentina baja al 127 y España, sin embargo, mejora hasta colocarse en el 50 del mundo.

Además, no se trata de una opinión aislada. La ONG Transparencia Internacional sitúa a Venezuela en el puesto 160 del mundo, de un total 175, en cuanto a percepción de la corrupción en 2013, y a Argentina en el 106, frente a la posición 40 que ocupa España.

Opacidad política y despilfarro de dinero

Otro de los indicadores relevantes que recoge el Índice de Competitividad es el relativo a la eficiencia gubernamental. Pero, más allá de la buena o mala gestión presupuestaria, destacan dos aspectos muy relacionados con el modo y forma de hacer política: la opacidad y el despilfarro.

La "transparencia en políticas públicas", entendida como la facilidad que tienen las empresas para obtener y conocer los cambios jurídicos y regulatorios que afectan a su actividad, brilla por su ausencia: Venezuela vuelve a ocupar la peor posición del mundo (144) y Argentina se mantiene a la cola del ranking (135), mientras España se coloca en el 105.

La situación es muy similar si se analiza la eficiencia en el gasto público, medido, directamente, en términos de despilfarro de dinero por parte del Estado: Venezuela (144) y Argentina (142) sacan peores notas que España (113).

Arbitrariedad e inseguridad jurídica

Asimismo, el problema de la corrupción suele ir asociado a una deficiente seguridad jurídica, en el sentido de que las leyes pueden ser retorcidas e interpretadas a gusto del poder político, vulnerando los principios básicos del Estado de Derecho. La cuestión, sin embargo, es que los referentes políticos de Podemos no se caracterizan, precisamente, por ser estados rigurosos y fiables en materia jurídica, sino todo lo contrario.

Los regímenes socialistas de Venezuela (144) y Argentina (141) son ejemplos de absoluta arbitrariedad política -España ocupa el puesto 92 del mundo-, debido a su manifiesta ausencia de independencia judicial y favoritismo gubernamental.

Crimen y violencia

Por último, cabe señalar, igualmente, la percepción de inseguridad personal, crimen y violencia, ya que el mantenimiento del orden público es una de las principales tareas que tiene encomendado todo estado, con independencia del sistema político bajo el que opere.

Bajo el epígrafe "seguridad", que engloba el coste del terrorismo y la violencia sobre la actividad económica, así como el impacto del crimen organizado y la fiabilidad de la Policía, Venezuela ocupa el puesto 141 del mundo, tan sólo por detrás de Yemen, Libia y Pakistán, mientras que Argentina se sitúa en el 105. España, por el contrario, saca una buena nota en esta materia, alzándose en la posición 36 del ranking.

España presenta grandes deficiencias a nivel político, pero el modelo socialista que tanto admira y aplaude Podemos saca unas puntuaciones mucho peores en todos los indicadores relacionados con la percepción de la actividad política, según revela el Foro Económico Mundial, tales como corrupción, transparencia, despilfarro, seguridad jurídica o seguridad personal, entre otros.

España, en el puesto 29 de 30 de la OCDE en barreras a las empresas

Que el entorno institucional y legal en España no es el más favorable para la iniciativa empresarial es algo más o menos conocido. La publicación de las clasificaciones internacionales clásicas (desde el Doing Business del Banco Mundial al Índice de Libertad Económica del Wall Street Journal y la Fundación Heritage) es un recordatorio periódico de que queda mucho por hacer en un terreno tan importante. Nuestro país no sólo no fomenta la creación de riqueza, sino que la penaliza. Pero hay días en que esta realidad es aún más palpable.

Este lunes, por ejemplo, la OCDE publicaba su informe bianual sobre la economía española. Es un estudio que incluye desde previsiones de crecimiento a recomendaciones sobre reformas políticas. Y también se analizan diferentes aspectos de nuestra coyuntura.

Así, los autores dedican un apartado a la legislación en materia empresarial, el entorno en el que se mueven las compañías y las facilidades que encuentran para nacer y desarrollarse. Pocas noticias buenas pueden extraerse de estas páginas.

De hecho, en este caso puede rescatarse aquello de que a veces una imagen vale más que mil palabras. Según la OCDE, de los 30 países que forman este club de naciones desarrolladas, España ocupa el puesto 29 en la clasificación de "barreras a la iniciativa empresarial". Sólo Israel lo hace peor.

No se queda ahí la cosa. En lo que hace referencia a los sistemas de licencias y permisos, ocupamos el puesto 25º, con sólo cinco países por detrás.

Y si nos centramos en las barreras en el sector servicios, la cosa tampoco varía mucho. Puesto 26º, con sólo cuatro países con peor nota.

Cuestión de tamaño

Las consecuencias de estas trabas pueden encontrarse en el mismo informe de la OCDE. En ese mismo epígrafe, los autores analizan el tejido empresarial de los grandes países de la UE: Alemania, Reino Unido, España, Francia e Italia. Según sus datos, España tiene una de las mayores proporciones de microempresas (de 0 a 9 empleados) y de pequeñas empresas (10-49 empleados).

No es una cuestión baladí. Las empresas grandes suelen ser más productivas que las pequeñas, por lo que interesa que las compañías exitosas puedan desarrollarse sin trabas.

Todos los países se basan en su red de pymes (incluso en Alemania suponen más del 95% del total, con un 80% de microempresas). Pero eso es compatible con que aquellas que van creciendo de forma orgánica puedan hacerlo de forma natural. Y eso es lo que no ocurre en España.

Es una pena. Según las cifras de la propia OCDE, la productividad de las empresas medianas y grandes en España es equiparable a la de sus competidoras de la UE. De hecho, están en la parte alta de la lista. El problema no es que no tengamos compañías competitivas, sino que limitamos las posibilidades de crecimiento de muchas de ellas.

Productividad por tamaño de las empresas

El informe también dedica parte de su análisis a un marco regulatorio que califica de "fragmentado, tanto a escala local como autonómica". En este sentido, admite que el Gobierno ha aprobado una Ley de Unidad de Mercado que debería ayudar a resolver este problema.

La pregunta es si esta nueva normativa se aplicará y cumplirá su cometido. Los autores admiten que "la rápida aplicación de la ley será crucial para impulsar el crecimiento del sector empresarial español".

En este mismo sentido, la OCDE recuerda que "ciertas partes del sistema tributario al que se encuentran supeditadas las empresas no resultan favorables para su crecimiento". En España existen numerosas normas duales. Hablamos sobre todo de ventajas a las que sólo las pymes se pueden acoger.

En principio, esto se suele vender como trato favorable al pequeño. El problema es que la consecuencia final es que limita el crecimiento. Si pasar de 49 a 51 empleados supone demasiados cambios, puede que el empresario se lo piense muy mucho.

Quizás prefiera quedarse en esos 49 y subcontratar algún proceso o no cubrir la demanda de nuevos clientes porque no le salga rentable. Puede parecer poco importante. Pero a medio plazo, puede que esa decisión implique que cinco años después una compañía que podía haber crecido hasta los 75 u 80 empleados sigue con 49 trabajadores.

La psicología moral y el liberalismo

Tradicionalmente los filósofos han pensado y discutido sobre ética o filosofía moral: desde diferentes escuelas (utilitarismo, consecuencialismo, deontología, ética de las virtudes, contractualismo, comunitarismo, liberalismo, iusnaturalismo, objetivismo) han argumentando, justificado o legitimado los valores, lo correcto, lo bueno, lo justo, las prohibiciones, los deberes y los derechos.

En contraste con la filosofía moral, la moderna ciencia de la psicología moral describe y explica cómo los seres humanos piensan y sienten el ámbito de la moralidad y por qué lo hacen así. Esta ciencia emplea diversas herramientas como la exploración de la actividad cerebral (neurociencia) durante determinadas tareas cognitivas con contenido moral, los experimentos de interacción estratégica entre individuos (juegos cooperativos o competitivos), o la observación de reacciones y su argumentación ante casos problemáticos, dilemas o paradojas morales.

La psicología moral estudia las semejanzas y diferencias entre sujetos según edad (bebés, niños, adolescentes, adultos, mostrando el desarrollo durante la vida del individuo), sexo, cultura, orientación política (conservadores, progresistas, liberales), religión (creyentes de distintas fes, ateos); son especialmente interesantes las disfuncionalidades o anormalidades cerebrales (por accidentes, patologías o intervenciones quirúrgicas) y las enfermedades mentales. También se estudian los orígenes de la moralidad en otros animales sociales, concretamente en ciertos primates (chimpancés, bonobos, gorilas).

La moralidad tiene componentes genéticos y culturales, naturaleza y entorno: instintos naturales heredados e influencias sociales adquiridas. La mente no es una hoja en blanco infinitamente moldeable sino que tiene predisposiciones innatas, algunas de ellas muy fuertes y difíciles de modificar o reprimir.

La moralidad es fundamentalmente emocional: se trata de sensaciones, emociones o sentimientos morales. La razón casi nunca es la fuente de las valoraciones éticas: los humanos primero tienen intuiciones morales (reacciones automáticas resultado de la actividad inconsciente del cerebro), y posteriormente argumentan y racionalizan para intentar defender su postura; el pensamiento desapasionado, imparcial o desinteresado es raro, y abundan los sesgos, los errores sistemáticos, el engaño (incluido especialmente el autoengaño) y la hipocresía. La argumentación ética es a menudo una cuestión de imagen, de reputación, de relaciones públicas, de estatus intelectual y social, de justificación propia y de manipulación de la conducta ajena.

La moralidad es una adaptación evolutiva que sirve para unir y coordinar a los miembros de un grupo cooperativo y para diferenciarlos y separarlos de individuos de otros grupos contra los cuales pueden competir (selección de grupo en evolución multinivel): no se daña y se ayuda a los miembros de la comunidad (familia, tribu, clan, nación); se ignora, se discrimina o se lucha contra individuos de otros grupos.

La moralidad opera en varios ejes o parámetros fundamentales que se calibran o modulan de forma diferente en los distintos individuos: daño/cuidado (no hacer daño; preocuparse por otros y ayudarlos, compartir, colaborar, fomentar el altruismo y reprimir el egoísmo); justicia (como igualdad o equidad en sus diversas alternativas, o como mérito por esfuerzo o resultados); lealtad (compromiso con el grupo, no traicionarlo, distinguir a nosotros de los otros, a los de dentro de los de fuera); autoridad (respeto y obediencia a los jefes y superiores responsables de la coordinación del grupo); pureza (lo sagrado, lo divino, los símbolos del grupo, lo impuro o tabú, el asco y la indignación); libertad/coacción.

La psicología evolucionista enseña que los humanos tienen mentes adaptadas a los entornos primitivos en los cuales se desarrollaron: grupos relativamente pequeños, cerrados, simples, estáticos, pobres. Algunas de estas adaptaciones pueden ser disfuncionales en entornos modernos: sociedades extensas, abiertas, complejas, dinámicas y ricas. El tribalismo moral y la oposición a los intercambios impersonales en los mercados pueden dificultar el progreso económico y la armonía social.

El liberalismo es una filosofía moral y política que se basa en la libertad como no violencia, agresión o coacción. No obliga a ayudar a nadie; es individualista y universalista, no distingue entre grupos ni exige lealtad ni obediencia a ninguna autoridad; no se ocupa de temas relacionados con la pureza o la divinidad. Por eso resulta extraño e incluso inaceptable para la mayoría de las personas con fuertes instintos tribales, que creen que ayudar es un deber ineludible, o que sienten fuerte asco o indignación ante violaciones de ciertas normas relacionadas con temas sagrados. Independientemente de si los liberales son buenos o malos vendedores de sus ideas, estas son muy difíciles de popularizar.

Podemos y el centro de gravedad político

Al parecer, la fuerza del nuevo grupo político Podemos crece y crece frente a la mirada medio expectante, medio aterrada de las formaciones tradicionales de nuestro panorama político. Una de sus características más llamativas, el sistema organizativo asambleario, suele apuntarse como un fallo garrafal, de bulto. Sin embargo, un hervor neuronal más puede ayudarnos a enfocar los beneficios de las asambleas.

¿Quién maneja nuestra barca?

El problema de las asambleas no es de los asamblearios sino del líder que tiene que moderarlas. Y más en un país como el nuestro donde a cada uno le gusta el café de una manera: corto de café con la leche fría, americano con sacarina, doble con dos bolsitas de azúcar. Se diría que hay un café por ciudadano. De la misma forma, parece que cada español es árbitro, juez, economista, teólogo y lo que sea menester, eso sí, en el bar y con los amigos. Así que, reunidos en asamblea y preguntados por soluciones, alternativas, propuestas, los españoles funcionamos muy bien. El que tenga que aunar mentes y actos que se prepare, que para eso es líder.

Y la gente se queda tan relajada pensando que opina, hace, participa, que maneja de alguna manera su propia barca, que no es un títere movido por los hilos que convienen a otros. Yo estuve en una asamblea de economía del 15M y propuse que se abolieran los bancos centrales. A la gente le encantó la idea. También les encantaron las tres siguientes: nacionalización de la banca, nacionalización de las empresas de energía y establecimiento de un salario máximo para las empresas privadas. No volví. Con la ilusión que me hizo explicar mis razones con el megáfono en la mano, me sentí tan decepcionada al comprobar que los que escuchaban no tenían criterio y aplaudían casi todo, que me planteé por qué alguien con dos dedos de frente puede defender el sistema asambleario.

La primera razón, obviamente es que la gente afianza su sensación de pertenencia y de control. Es verdad que cuando llegue el momento y las asambleas eleven sus propuestas a las asambleas de mayor grado y estatus y siga el proceso ascendente, la propuesta de la señora del tercero poco va a contar. Pero mientras tanto, la señora del tercero ha aportado algo y siente que ella es sociedad civil.

Pero hay más razones. Y creo que la principal es la exculpatoria. Es la mejor solución para los presuntos líderes del cambio. Les permite proponer cualquier cosa y no ser responsables de nada.

El efecto “Fuenteovejuna” en la política

Cuando todos deciden, el líder queda exento de responsabilidad alguna: la gente lo ha querido así. Excusas como “lo hemos decidido en asamblea” es lo mismo que decir que no hay responsables. En efecto, la señora del tercero, los que hablamos en el megáfono, los que levantaron su mano, todos seríamos los responsables de cualquier decisión por brutal que ésta sea. Si votamos todos, todos asumimos firmamos y sancionamos. Y eso le da espacio al líder para ir en dos direcciones opuestas.

Podemos proponer cualquier imposible, el famoso “unicornios para todos”, porque nos respalda un sistema estructurado en “círculos” donde cabe todo, sobre todo porque es gratis, y donde haya tres o más reunidos para pedir, allá está Pablo Iglesias. ¿Para pedir qué? No importa, que venga a nosotros el Islam o la renta universal. Eso sí, como la dirección (los de arriba, los que piensan, los que salen en la tele, se sientan en los escaños y cobran) ha mandado por correo electrónico las bases ideológicas del partido, se supone que todos las respetamos. Y por eso cada día es un festival de titulares extravagantes con el tándem Iglesias-Monedero diciendo barbaridades, generando noticia, ocupando gratis espacio publicitario, creando opinión y transmitiendo viralmente su mensaje.

También Podemos bajarnos del proyecto, desdecirnos, arrugarnos sin dolor, sin precio, sin responsabilidad. Porque siempre hay una asamblea que vota a quien echar la culpa. Y claro, si la gente que se reúne propone esto, yo que soy líder pero no impongo mi criterio, porque no soy casta, no manipulo ni entro en los entresijos del poder, pues estoy fuera, ha sido Fuenteovejuna, señores. Cae el telón, y Pablo y Juan Carlos se van de rositas después de haber chafardeado, mentido, prometido imposibles y de haber manipulado sin sonrojo el malestar natural de unos españoles empobrecidos y muy cansados del zoo político en el que vivimos.

De esta forma magistral, Podemos logra cambiar el centro de gravedad de la política, la responsabilidad, desde los propios políticos hasta los ciudadanos asamblearios. Y Pablo Iglesias y los elegidos, que no son casta, se lavan las manos. Esperemos que en la balanza de la ciudadanía pese más la sensatez frente al populismo. Y según lo escribo me da la risa floja…

Juncker y la derecha

En las crónicas sobre la elección del político luxemburgués Jean-Claude Juncker como presidente de la Comisión Europea hubo un calificativo unánime: "De derechas".

El señor Juncker se opuso radicalmente a la austeridad, y afirmó que en Europa los gobiernos habían pecado por haberla practicado en exceso. Ahora ha llegado el momento de "impulsar el crecimiento y el empleo". ¿Cómo se hace eso? Pues muy sencillo: con más gasto público. Y Juncker, que es un señor de derechas, como nos insistían los medios de comunicación, propuso gastar en grandes cantidades, y esos medios se entusiasmaron con la idea de "movilizar" –que es como se dice ahora gastar, pero en plan guay– 300.000 millones de euros, nada menos. Asimismo, el nuevo presidente electo, de derechas, sugirió que habíamos ido demasiado lejos en el frenesí liberal y que había que intervenir más, por ejemplo, subiendo el salario mínimo.

Una forma de analizar este asunto es, naturalmente, subrayar su naturaleza disparatada. Los gobiernos no han sido los protagonistas de la austeridad, sino que se han lanzado a imponer la austeridad sobre sus súbditos, subiendo los impuestos. En ese proceso profundizaron la crisis y retrasaron la recuperación. No se impulsa el crecimiento y el empleo aumentando el gasto público, es decir, la presión fiscal, sino más bien al contrario.

Otra manera de verlo es comprender lo insensatas que resultan las etiquetas políticas cuando lo que prevalece, como diría Hayek, es el socialismo de todos los partidos. Lo comprobamos en nuestro país cuando Barbie subió los impuestos para defender el Estado del Bienestar, copiando punto por punto la barbaridad perpetrada antes por Smiley.

No tiene sentido, en efecto, insistir en que Juncker es de derechas cuando todas sus recomendaciones podrían ser perfectamente asumidas por la izquierda. Y los socialistas europeos hicieron efectivamente el ridículo negándose a apoyarlo cuando decía lo mismo que ellos.

El Señor No

Fue hace dos años y medio. Era mi primer debate televisado en horario de máxima audiencia y la cuenta atrás para el directo se me hizo eterna. Repasé cien datos para estar a la altura de las circunstancias, saludé a los demás invitados y me dispuse a ocupar mi asiento. En ese momento entró en el estudio el profesor José Barea, cuya participación en el programa se había cerrado en el último minuto. Todos los allí presentes se levantaron casi al instante y acudieron a saludarle con admiración.

Comenzó el debate y Barea no tardó en sentar cátedra. A sus 89 años sufría ya un grave problema de movilidad… pero se convertía en un gigante de la divulgación en cuanto la luz roja de la cámara se encendía. Durante dos horas pude ver cómo aquel hombre de tan avanzada edad brillaba con luz propia a la hora de rebatir los argumentos de la irresponsabilidad fiscal, esos que siempre le irritaron.

Muchos recordarán a Barea como el artífice de la estabilidad fiscal alcanzada por el Gobierno de José María Aznar. Desde la Dirección de la Oficina Presupuestaria de La Moncloa, Barea promovió medidas de austeridad que, desplegadas a lo largo de dos legislaturas, redujeron el gasto público de más del 44 a menos del 38% del PIB. Estas decisiones, que en ocasiones le generaron roces con el equipo del ministro Rodrigo Rato, fueron sin duda esenciales para que España entrase en el la Moneda Única y también para que los españoles se ahorrasen cientos de euros al año en sus pagos a Hacienda.

Dentro y fuera del aznarismo se recordó al veterano profesor como un especialista en el diseño de políticas de ahorro fiscal. Algunos le llamaban "profesor manostijeras", aunque en el círculo más cercano al Gobierno también era habitual escuchar a quienes se referían a él como el "Señor No", por las recurrentes negativas que daba la Oficina Presupuestaria cada vez que se proponía una expansión del gasto público o una medida incoherente con los objetivos de responsabilidad fiscal.

En 2012, coincidiendo con aquel debate en el que participamos, fue el Gobierno de Esperanza Aguirre el que quiso contar con su consejo para configurar los presupuestos autonómicos. En una entrevista que mantuvimos tras su salida del Ejecutivo regional, el ya exconsejero Percival Manglano me habló de las reuniones en las que el profesor Barea se unió al equipo de gobierno y, como había hecho antaño, volvió a identificar nuevas vías de ahorro.

Más recientemente, el profesor pidió al Gobierno de Rajoy que hiciese lo propio y apostase por menos impuestos y más recortes del gasto. Advirtió además de que el "excesivo uso de la imposición fiscal" es "contraproducente" y genera “asfixia” al sector privado. Esto mismo defendía por aquel entonces David Taguas, quien también nos dejó este año, sin duda demasiado pronto.

Nunca faltarán los que critican la "inflexibilidad" de hombres coherentes y serios como Barea. Pues bien, como en su día afirmó el columnista conservador George F. Will, debemos darle un enfático sí a quienes, como Barea, no dudaron en decir no ante el tipo de recetas que, cuando han sido aplicadas, han llevado a España a la crisis y el empobrecimiento.
